General Terms and Conditions (Ts&Cs)
Area of validity: These General Terms and Conditions apply to all non-binding reservation enquiries and also for binding online bookings made via hotelbaer.com (subsequently referred to as ZB).
For all further issues the General Terms and Conditions for the hotel industry (AGBH 2006) are binding.
Reservation enquiry and booking: Every enquiry or booking will be forwarded via ZB on your behalf to the hotel Der Bär. No-obligation reservation enquiries are sent via e-mail to the hotel and a response from them is sent to you directly without delay, providing an offer, or the information specifically requested by you. In contrast, bookings for individual services and package offers via ZB are binding. Bookings for accommodation and travel services are concluded via the click of a mouse; your attention is drawn to the respective stated cancellation deadlines and conditions. The hotel Der Bär has the option of declining a booking within a 24 hour period.
Accommodation or Travel Service contract, and payment: The Accommodation or Travel Service contract during a booking is effected straight-away between you and the hotel Der Bär. You are to pay the confirmed rate direct in the hotel in cash, or using a current credit card. All claims and liabilities resulting from the Accommodation or Travel Service contract are directly and solely between the booker and the hotel Der Bär.
Amendments and cancellations: Reservations must be held by the hotel up to 6.00 p.m. and after, that is, for the whole night.Right of rescission in accordance with § 18 Para. 1 Line 10 FAGG is not applied; rather the following cancellation conditions apply:
The following cancellation conditions apply to all reservations (excluding Christmas and New Year stays):
- up to 14 days before arrival, cancellation is free
- from 13 days before arrival, 100% of the total price
- no show 100%
Cancellations must be made directly with the hotel Der Bär (info@hotelbaer.com).
During Christmas and New Year's Eve the following cancellation conditions apply here with us:
- up to 28 days before arrival, cancellation is free
- up to 21 days before arrival, 70% of the total price
- up to 14 days before arrival, 80% of the total price
- from 13 days before arrival, 100% of the total price
- no show 100%
For group reservations, the following cancellation conditions apply:
- up to 3 months before arrival cancellation is free of charge
- from 3 to 1 month before arrival, 40% of the total price
- from 1 month to 2 weeks before arrival, 70% of the total price
- from 14 days before arrival, 100% of the total price
- no show 100%
Hotel categories and hotel/travel information: International standard hotel classification using stars provides a no-obligation indication of the standard of the hotel, allowing for the hotel's own self-rating. All additional hotel and travel information and descriptions are based on the hotel's own information.
Contractually agreed room prices: All prices that appear in the system are current day prices and special rates (which can change at any time), and apply to all bookings made via ZB. Bookings are effected at the respective best, most up-to-date hotel Der Bär day price for the travel date selected and indicated on the hotel Der Bär's behalf. Any available last-minute, seasonal, weekend or special promotional prices at the Hotel Der Bär will automatically be considered when making the booking.
Miscellaneous: All information has been compiled with the utmost care. However, no liability can be assumed for any errors in data acquisition or data transfer. Acquisition of data for other data carriers, even in part, or use for other purposes than is intended is only permitted upon the express approval of the hotel Der Bär.
Applicable law: Austrian law applies. Court of jurisdiction is Kufstein, Austria.
Statement on data protection
The hotel Der Bär would like to foster your confidence with regard to make an online reservation of individual services & package offers. For this reason we consistently provide information here as to,- what information is gathered about you and
- how this information will be used.
Anonymous use of the reservation service: As a general rule you may call up our reservation service, without having to provide any information about yourself, i.e. anonymised use is possible. This means that you can get information, about an offer for example, without having to register. Registration: If you would like to access the site for the hotel Der Bär as the person making the reservation or booking, or as a hotel or travel operator, we require personal details such as your name and address to effect the transaction. You will be expressly informed about this data collection as part of your registration. This compulsory data, the scope of which can be gathered from the registration form, will be required and processed to structure the contractual relationship. In addition, based on this compulsory data you will receive regular newletters from the hotel Der Bär. You can unsubscribe from this at any time. Information regarding details listed as voluntary are not strictly required for registration. Should you enter information voluntarily these will be in anonymised form and used for statistical purposes.
